For all of you that remember I am the one who had my picture copied out of my gallery and used on Ebay. I am now fairly certain that I know who this person is. What would you do?
I told my DH about it and he thinks she should be banned from this site. He belongs to a salt water reef/fish web site and says people get banned from there for doing similar things.
She has not made any attempt to contact me, apologize or explain herself. She is on this site and is signing up for swaps and may still be on Ebay. Should I confront her?
I would really love to hear your feeling and opinions.
Geeze Louise! I can't believe anyone would even think of copying like that and now I see that she actually posted YOUR photo to her ebay listing without even showing any one her own work!

She knew that what she was doing was *wrong*! It is one thing to CASE someone else's work to learn a new technique, because you like the layout/card so much you want it for your *own* collection, or to have "on hand" to show your customers instead of having to refer them to a website. It is *COMPLETELY* different to copy a photograph, paste that photograph on another site and present it as though it were her own work, and attempt to *sell* that work *for profit* through that misrepresentation.
I agree with everyone else that you should go through the moderators. But I think that you should make a *very* strong case: if you can prove that it is her, she should not be welcomed back. *PERIOD*. And if she is a demo, SU! should be advised *IMMEDIATELY* if she violated policy.
End of story. To mess up on one's own behalf: that can be an oversight (forgiveable), ignorant (mild consequence), or a choice (more severe consequences.) To do what this woman did [** STEALING **] is not an oversight. It should be punished. ~ K

Not only is it heinous that she potentially stole *your* work without giving proper "props," but she is selling a gift certificate redeemable only through her and she signs the post that she is a SU demo. Um, hello?!?! That is clearly in violation of SU policy, as well as the at least moral policy of downright stealing someone else's work. If she were in college and completely plagerized a paper, she would be given zero credit or even suspended. What's the difference? It really burns me up that she blatantly posted her demonstratorship on there..."if you have a flush of joy from seeing the Spring mini, call me immediately - I have the cure!" OMG, she's unbelieveable!

I think you should take it to the moderators & let them sort it all out. You have all the info you need & can definitely show it was your picture & that the ebayer definitely advertised as a demo (although I don't think anyone here can do anything about that....that is up to SU).
I think if you are going to use this site, there has to be some kind of trust involved. It would be pretty bad if all of a sudden we found pics of one of our items listed on ebay by someone else

Hope this is over soon. I hate to see one person (not you, the thief) cause so much strife.....we need to be stamping & scrapping instead of stealing & cheating.

Oh, and I didn't appreciate the religious reference in gest ...(even though I'm not overly religious. To me, its a personal thing that should not be taken in vain) But to joke on her auction that she is there to "serve the Lord," and then have the audacity to do what she is doing...whew! That takes a lot of hootspa! :twisted:

I noticed that too & I just think maybe she did make an honest mistake & maybe she didn't think anyone else would see the auction & maybe, maybe, maybe....
I would like to think I live out what I have written on my signature....trying to every day. So maybe that's why I am trying to give "her" the benefit of the doubt......

BTW, the spelling is chutzpah. But it's pronounced pretty close to the way you wrote it. Either way, it means she has a lot of nerve!!

wow...this is just crazy....some people have a lot of nerve, and to think, she put shame on the name stephanie....im a stephanie, and that's down right rude!!

Seeing as she put her name, email, etc in the ebay ad for this product I would first of all email her and ask her point blank what she was thinking. I would attach a read-receipt to that email (you can opt for your email messages to have a "thing" attached to them that notifies you when someone reads an email you have sent them) so that you know she has seen it. If she fails to respond or does not respond satisfactorily - private apology to you, public apology to the rest of the world, proper credit given on Ebay site...the works - then go the next step and put it through the moderators. As angry as this would make me, it would also make me angry to not be dealt with directly first (given the chance to voice my side of the story).
I agree that if the person INTENTIONALLY did something they know is wrong, we/you have ever reason to feel angry. BUT if the person just did it without thinking, something we all have done in one situation or another, then we/you should be giving her a chance to redeem herself. She could be one of those people who doesn't actually read contracts before signing them (I used to be like that - who could be bothered to read all the fine print anyway! - but I changed when I ran into a problem quite by accident!) and didn't know you can't sell on Ebay. You never know until you talk to them FIRST.

That was a big, double "NO-NO" that she did, selling a certificate on Ebay and using your pic! And apparently she knows it since she ended the auction early! She should be ashamed and obviously knows better and didn't think she would be busted, or she would have already commenced with apologies.
I'm sorry somebody copied & pasted the picture into an auction and I agree that it shouldn't have been done. And of course we all know that demos aren't permitted to sell or solicit on ebay. But it's distressing to see such an outpouring of ill will and animosity! It does us no credit as a stamping community.

Does anyone else wonder if the errant eBayer has read/is reading these posts?
You'll never know what actully happened until you discuss it with her, but I think you should go through a moderator. The moderator would prevent you from (unknowingly) doing something wrong & making the situation worse.
I thought I remembered reading in one of the other threads that you had contacted SU! I also thought that they "prosectued" heavily those in violation of the eBay policy. IMHO, she should have been "defrocked" for this. Ignorace of the rules is no excuse for breaking them.

Back to the issue...Since she put out all of her info, I'd make a safe bet that she thought it was a great idea, and that she could make it and sell it to make some extra dough, probably has a couple of kids, etc... Can guarantee she never thought you had the "copyright" to it. You do have that, right? A-hem.
I don't always like e-bay because of the people that break the rules, but they do it in such a sneaky way. Not outright with all of your info like this girl did it. :shock:
The auction is against our demo contract, and she obviously copied your item that you posted here for all of us to share, yet she still put her info on the auction. She also ended the auction. Seems like ignorance not purposeful rule-breaking. Have you thought to contact her before you berated her publicly?

Ok, now in some other thread someone was angered at a comment about having too much time on one's hands...I totally agree when it comes to card making...one can never have enough time, and bad toughts to whomever said it to her...

Actually, being a student of the Hebrew language of late, the spelling chutspah is more correct. The pronunciation starts with a throat clearing kind of sound, "ch"ootspah.
But....maybe that's a little too much information!
First of all I would like to thank all of you for your support (and humor :lol: ) over the last couple of weeks.
I did seek the advice of a moderator, while they are sorry that this happened there is nothing than can do. They suggested that I try to work it out with her myself. So, I feel somewhat deflated at this point. :( I had really hoped there was some kind of rules in place regarding this issue.
